Terms of Purchase

1. General Provisions

These Terms of Purchase (hereinafter: Terms) govern the rights and obligations between the seller and the buyer when purchasing through the online store slikica.com (hereinafter: Online Store).

The Seller is Stolarija Rusan, with registered office at Karivaroš 35 A, 49245 Gornja Stubica, OIB (Tax ID): 79199048265, MBS: 91118280, registered in the court register of the Commercial Court in Zagreb (hereinafter: Seller).

The Buyer is any natural or legal person who places an order through the Online Store (hereinafter: Buyer).

By purchasing through the Online Store, the Buyer accepts these Terms in their entirety.

2. Subject of the Contract and Pre-Contractual Information

In accordance with the Consumer Protection Act (OG 19/22, hereinafter: CPA), before concluding a distance contract, the Buyer is informed of the following:

• Main characteristics of goods: Personalized posters, canvas prints, collages, and FotoMix products made from photographs provided by the buyer.
• Price: All prices in the Online Store are expressed in euros (EUR) and include VAT (25%).
• Payment methods: Credit and debit cards (Visa, Mastercard, Maestro) via the CorvusPay system, and bank transfer (wire payment).
• Delivery time: Products are made to order. Production time is 2–5 business days, and delivery takes 1–3 business days after production.
• Shipping costs: Shipping costs are calculated according to the shipping price list and are displayed before completing the order.
• Right of withdrawal: The Buyer has the right to withdraw from the contract within 14 days of receiving the goods, except in cases specified in Article 79 of the CPA.

3. Prices and VAT

All prices in the Online Store are expressed in euros (EUR) and include value-added tax (VAT) at a rate of 25%.

The Seller reserves the right to change prices without prior notice. Prices valid at the time of order confirmation are final for that order.

The total order price includes the product price, personalization costs (if any), and shipping costs.

4. Payment Methods

The Online Store offers the following payment methods:

• Card payment: Visa, Mastercard, and Maestro cards via the CorvusPay secure online payment system. All card data is protected by SSL encryption and PCI DSS standards.
• Bank transfer: Payment to the Seller’s business account. Payment details are sent by email after order confirmation. The order is processed upon receipt of payment.

5. Ordering and Conclusion of Contract

The ordering process consists of the following steps:

1. Product selection and personalization (photo upload, format and material selection)
2. Adding the product to the cart
3. Entering delivery information and selecting payment method
4. Reviewing the order and confirming
5. Completing payment

The purchase agreement is considered concluded when the Buyer receives the order confirmation at their email address.

6. Delivery

Delivery is carried out within the territory of the Republic of Croatia via reliable delivery services.

Timeframes:

• Product production: 2–5 business days
• Delivery: 1–3 business days after production
• Total: 3–8 business days from order confirmation

In case of delay, the Seller will inform the Buyer of the new delivery date.

7. Right of Withdrawal

In accordance with Articles 72–79 of the Consumer Protection Act, the Buyer has the right to withdraw from a distance contract within 14 days of receiving the goods, without stating a reason.

IMPORTANT NOTE: Pursuant to Article 79, Paragraph 1, Point 3 of the CPA, the right of withdrawal does not apply to contracts for the supply of goods made to the consumer’s specifications or clearly personalized for the consumer.

Given that the Online Store products (posters, canvases, collages) are personalized according to photographs provided by the Buyer, they constitute goods made to consumer specifications, and the Buyer does not have the right to withdraw from the contract for such products.

Exceptionally, if the product has a material defect (damage in transport, manufacturing error, etc.), the Buyer has the right to file a complaint in accordance with the provisions on liability for material defects.

8. Complaints and Material Defects

The Buyer is obliged to inspect the product immediately upon receipt. If a defect is found, the Buyer must notify the Seller within 2 months of discovering the defect.

The complaint must include: order number, description of the defect, and a photograph of the product.

The Seller is obliged to respond to the complaint within 15 days of receipt.

9. Warranty (Guarantee)

The Seller provides a warranty on product quality:

• Canvas prints: Lifetime warranty on print quality and color durability
• Posters: 30-day warranty on print quality
• FotoMix products: 30-day warranty on print quality

The warranty covers defects in material and workmanship but does not cover damage caused by improper use, storage, or external factors.

10. Personal Data Protection

The Seller processes the Buyer’s personal data in accordance with the General Data Protection Regulation (GDPR) and the Act on the Implementation of the General Data Protection Regulation. More information is available in the Privacy Policy.

11. Dispute Resolution

In the event of a dispute, the Buyer and the Seller shall endeavor to resolve the dispute amicably. The Buyer may submit a written complaint to the Seller’s address or by email to info@slikica.com.

The Seller is obliged to respond to the complaint within 15 days.

For disputes that cannot be resolved amicably, the competent court at the Seller’s registered office shall have jurisdiction.

The Buyer may initiate an alternative dispute resolution procedure via the European Commission’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

12. Final Provisions

All matters not regulated by these Terms shall be governed by the provisions of the Consumer Protection Act, the Obligations Act, the Electronic Commerce Act, and other applicable laws of the Republic of Croatia.

The Seller reserves the right to amend these Terms. Amendments shall take effect on the date of publication on the Online Store.
